End User Licence Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you ("End User") and Anna Dai ("Licensor") for the use of the Luni mobile application ("App"). This EULA complies with Apple's standard EULA requirements as specified in the App Store Review Guidelines.

1. Acknowledgement

You acknowledge that this EULA is concluded between you and Anna Dai (the Licensor) only, and not with Apple Inc. ("Apple"). Anna Dai, not Apple, is solely responsible for the App and its content.

2. Scope of Licence

The Licensor grants you a non-transferable licence to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service.

This licence does not allow you to use the App on any device that you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

The App offers optional premium features available as a one-time in-app purchase ("Luni Premium"). In-app purchases are processed by Apple and are subject to Apple's payment terms. The Licensor does not handle payment information directly.

In-app purchases are generally non-refundable. To request a refund, contact Apple at reportaproblem.apple.com.

4. Maintenance and Support

The Licensor is solely responsible for providing maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

In the event of any failure of the App to conform to the above warranty, you may notify Apple and Apple may refund your purchase price (if applicable). To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the App.

In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, the Licensor (not Apple) will be solely responsible for the investigation, defence, settlement, and discharge of any such intellectual property infringement claim.

The App uses Apple's CloudKit for data sync and sharing. Your use of CloudKit is subject to Apple's iCloud Terms and Conditions. You must comply with applicable third-party terms of agreement when using the App.

10. Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

11. Governing Law and Jurisdiction

This EULA is governed by the laws of Switzerland. Any disputes arising from this EULA shall be subject to the exclusive jurisdiction of the courts of Winterthur, Switzerland, unless mandatory consumer protection laws in your country provide otherwise.
